Helping veterans is the fuel that drives my passion. As luck would have it, VA law and elder law have become one and the same. These two areas of the law are equally intimidating and rewarding.
It has been said that the Medicaid Act is “an aggravated assault on the English language, resistant to attempts to understand it.” See Schweiker v. Gray Panthers, 453 U.S. 34, 43 (1981). This is the powerful message, conveyed at the NAELA website at http://www.naela.org. One of many examples is the recent change in the Monthly Annual Pension Rate (MAPR) Aid and Attendance (“A & A”).
Effective 12/1/08 the cost-of-living-allowance, or COLA, was increased yet another 5.8% by the VA. The increase and its effective date were placed on the United States Department of Veterans Affairs (VA) website, which is located at http://www.va.gov.
In spite of the sincere efforts by VA personnel, this cost of living increase places sometimes unbearable hardship on our clients and their families.
The VA figures for Aid and Attendance have risen as follows:
- Without dependents $19,736
- One dependent 23,396
- 2 vets married to each other 15,493
In conclusion, “America’s veterans deserve the best health care and compensation system we can provide.” (Anthony Principi, Secretary of Veterans Affairs, News Release, February 3, 2003).
